Terms of Service

The agreement between you and bartr. Please read it before you use the platform.

Last updated October 11, 2026

1. The Agreement

These Terms of Service (“Terms”) are an agreement between you and bartrhomes Inc. (“bartr,” “we,” “us”). They govern your use of our websites, apps, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 18 years old and able to enter into a binding contract. If you use the Services on behalf of a business, you confirm that you are authorized to bind that business, and “you” includes it.

Section 19 contains an agreement to resolve disputes with bartr by individual arbitration and a waiver of class actions. You can opt out of it within 30 days of first accepting these Terms.

2. What bartr Is, and Is Not

bartr is a technology platform. It gives homeowners tools to understand, manage, and sell their homes; gives buyers tools to find homes and contact owners directly; and lets homeowners hire local businesses for work on their homes.

bartr is not a real estate broker or agent, a lender or mortgage broker, an appraiser, a law firm, a title or closing company, a home inspector, or a contractor. We do not represent you or any other user in a transaction, we do not negotiate on anyone’s behalf, and nothing on the Services is legal, financial, tax, or real estate advice. You are responsible for your own decisions and for hiring licensed professionals — such as an attorney to handle your closing — where you need them or the law requires them.

bartr is not a party to any agreement between users, whether that is the sale of a home or a job performed by a business.

3. Accounts

You need an account to use most of the Services. You agree to give accurate information, keep it current, keep your sign-in credentials secure, and tell us promptly at support@bartrhomes.com if you believe your account has been used without your permission. You are responsible for activity under your account.

Some features require you to verify your identity, your ownership of a home, your pre-approval, or details about your business. Verification reduces risk but is not a guarantee: bartr does not vouch for any user, and you should use the same care you would in any significant transaction.

4. Claiming a Home

You may claim a home only if you own it or are authorized by its owner. We may ask you to prove ownership, and we may remove a claim that we cannot verify or that someone else disputes. Co-owners may each hold a claim to the same home.

bartr displays information about homes drawn from public records and third-party data. That information may be incomplete or out of date; if you own the home you can correct it once you have claimed it.

5. Value Estimates and AI Features

Pulse, equity figures, and other estimates on the Services are computed automatically from public records, market data, and the information you provide. They are estimates, not appraisals, and should not be relied on as the actual value of a home or used in place of a licensed appraisal, a lender’s valuation, or your own judgment. Mortgage, equity, and refinancing figures are illustrations based on the data available to us and are not an offer of credit.

Ask bartr and other AI features generate their output automatically. That output can be wrong, incomplete, or out of date. It is provided for information only, and you should verify anything important — including summaries of offers and contracts — before you act on it.

6. Listings

If you list a home, you confirm that:

  • you have the legal right to sell it;
  • everything in the listing is accurate and not misleading, and you will correct it promptly if that changes;
  • you have the right to use the photos and other content you upload; and
  • you will meet the legal duties of a seller, including making any property disclosures your state requires.

Fair housing. You must comply with fair housing laws. You may not state a preference for, limit, or discriminate against anyone on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, familial status, disability, or any other class protected by federal, state, or local law — in a listing, in a message, or in deciding whom to deal with.

We may remove or decline to publish any listing.

7. Knocks, Offers, and Sales

A knock is an expression of interest that a buyer sends to an owner. It may include a proposed price and terms, but it is non-binding: neither side is obligated by sending, receiving, or replying to one.

The Services include tools for making, countering, and documenting offers. Whether and when an offer becomes a binding contract depends on what the buyer and seller sign and on the law of the state where the home is located. Any contract for the sale of a home is solely between the buyer and the seller. bartr does not draft it for you, does not review it for legal sufficiency, holds no earnest money or sale proceeds, and does not conduct the closing. We strongly recommend that each side has an attorney review any contract before signing.

Buyers are responsible for their own inspections, financing, and due diligence. Sellers are responsible for clear title and for the accuracy of what they tell buyers. bartr does not guarantee that any user will complete a transaction.

8. Home Services

Through the Services you can request quotes from and book independent local businesses. Those businesses are not employees, contractors, or agents of bartr. The agreement for the work is between you and the business, and the business alone is responsible for its work, its licensing and insurance, and the people it sends to your home.

8.1 How Payment Works

  • When you accept a quote and book a job, you authorize us to charge the quoted price through our payment processor. The payment is held and is not paid out to the business at that point.
  • When the business reports the job complete, it submits proof of the work. You can then approve the work, ask for a revision, or raise a dispute.
  • When you approve, the payment is released to the business.
  • If you take none of those actions within 7 days after proof is submitted, the payment is released to the business automatically.

8.2 Disputes About a Job

If you raise a dispute before the payment is released, it stays on hold while we review it. We will consider what you and the business submit and decide either to release the payment to the business or to refund you. You agree that we may make that decision, and that our decision governs what happens to the held payment. It does not limit any other rights you and the business may have against each other.

Once a payment has been released, bartr cannot recover it; any remaining claim is between you and the business.

9. Terms for Businesses

If you offer services through bartr, you also agree that:

  • you hold every license, permit, registration, and insurance policy required for the work you offer, in every place you offer it, and you will show proof if we ask;
  • your profile, quotes, and proof of work are accurate, and you will perform each job with reasonable skill and care and as quoted;
  • you are an independent business, responsible for your own staff, subcontractors, taxes, and compliance with the law;
  • payment for a job is held and released as described in Section 8, and you accept our decision on a disputed payment;
  • payouts are made through Stripe, and to receive them you must accept the Stripe Connected Account Agreement and keep your payout details current;
  • customers may review your work, and we may display those reviews; and
  • you will not ask a customer you met through bartr to pay outside bartr for that job.

10. Fees and Payments

Creating an account, claiming a home, listing it, and sending or receiving knocks and offers are free for homeowners and buyers. bartr does not charge a commission on the sale of a home.

bartr charges businesses a platform fee on jobs booked through the Services and may offer optional paid features. Any fee that applies to you is shown to you before you incur it. Unless we say otherwise at the time, fees are non-refundable except where the law requires or as described in Section 8.

Payments are processed by Stripe. By making or receiving a payment you also agree to Stripe’s terms, and you authorize us and Stripe to charge the payment method you provide.

11. Your Content

You keep ownership of what you submit to the Services — listings, photos, documents, messages, reviews, and the like (“your content”). You grant bartr a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and adapt your content as needed to operate, improve, and promote the Services. For content you choose to make public, such as a listing or a review, that license continues for copies already shared or archived after you remove it. For private content it ends when the content is deleted, subject to our Privacy Policy.

You confirm that you have the rights needed to grant that license and that your content does not break the law or these Terms. If you send us feedback or suggestions, we may use them without obligation to you.

12. Acceptable Use

You agree not to:

  • give false or misleading information, impersonate anyone, or claim a home you do not own;
  • send a knock or an offer you do not intend in good faith, or misstate your identity, funds, or pre-approval;
  • break any law, including fair housing and consumer laws;
  • harass, threaten, or defraud anyone;
  • use another user’s information for anything other than the transaction it was shared for, including marketing to them;
  • post reviews that are fake, paid for, or about your own business or a competitor’s;
  • scrape, crawl, or copy the Services or their data by automated means without our written permission;
  • probe, bypass, or interfere with the security or operation of the Services, or access accounts or data that are not yours;
  • upload malicious code, or content that infringes someone else’s rights; or
  • send spam or unsolicited commercial messages.

We may investigate suspected violations and remove content or restrict accounts in response.

13. Electronic Communications

You agree that we may send you notices, disclosures, and other communications electronically — by email, in the Services, or by text message where you have given us your number for that purpose — and that these satisfy any requirement that a communication be in writing. Where the Services let you sign a document electronically, you agree that your electronic signature has the same effect as a handwritten one.

14. Intellectual Property

The Services — including their software, design, text, and data compilations — belong to bartr and its licensors and are protected by law. We grant you a limited, revocable, non-transferable right to use the Services for their intended purpose. “bartr,” the bartr logo, and “bartrPulse” are trademarks of bartrhomes Inc.; you may not use them without our written permission.

If you believe content on the Services infringes your copyright, send a notice to legal@bartrhomes.com identifying the work, the content you believe infringes it and where it appears, your contact details, a statement that you believe in good faith the use is not authorized, and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. We remove infringing content and close the accounts of repeat infringers.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BARTR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THAT, BARTR DOES NOT WARRANT THE ACCURACY OF ANY VALUE ESTIMATE, PROPERTY INFORMATION, LISTING, OR AI OUTPUT; THE IDENTITY, INTENTIONS, OR CONDUCT OF ANY USER; THE CONDITION, TITLE, OR LEGALITY OF ANY HOME; THE QUALITY, SAFETY, OR LEGALITY OF ANY WORK PERFORMED BY A BUSINESS; OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BARTR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, INCLUDING ANY TRANSACTION BETWEEN USERS.

BARTR’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BARTR IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) ONE HUNDRED DOLLARS ($100).

Some states do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

17. Indemnification

To the extent the law allows, you agree to defend, indemnify, and hold harmless bartr and its officers, directors, employees, and agents from any third-party claim, and any related loss, liability, or expense (including reasonable attorneys’ fees), arising from your content, your breach of these Terms or of the law, or a transaction or dispute between you and another user.

18. Ending the Agreement

You may stop using the Services and delete your account at any time from your account settings. If you have an open offer, booking, or dispute, you may need to finish or cancel it first.

We may suspend or close your account, or remove your content, if you breach these Terms, if we must do so to comply with the law, or if your use puts other users or bartr at risk. Where it is reasonable to do so, we will tell you why. Closing an account does not cancel payments already owed or held under Section 8.

Sections that by their nature should continue — including Sections 2, 5, 11, and 14 through 21 — survive the end of this agreement.

19. Disputes With bartr

19.1 Talk to Us First

If you have a dispute with bartr, email legal@bartrhomes.com with a description of it and what you are asking for. We will each try in good faith to resolve it within 30 days before either of us starts arbitration or a court case.

19.2 Agreement to Arbitrate

If we cannot resolve it, you and bartr agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitration will be held in the county where you live or by video, at your choice. The arbitrator may award any relief a court could award to you individually.

Either of us may instead bring an individual claim in small claims court, or go to court to seek an injunction protecting intellectual property.

19.3 No Class Actions

YOU AND BARTR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration.

19.4 Your Right to Opt Out

You may opt out of Sections 19.2 and 19.3 by emailing legal@bartrhomes.com within 30 days of first accepting these Terms, stating your name, the email address on your account, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

19.5 Governing Law and Courts

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, except that the consumer protection laws of the state where you live continue to apply to you where they cannot be waived. Any dispute that is not subject to arbitration or small claims court will be heard in the state or federal courts located in Durham County, North Carolina, and you and bartr consent to those courts.

20. Changes to These Terms

We may update these Terms. When we do, we will change the date at the top of this page, and if the change is material we will tell you by email or through the Services before it takes effect. If you keep using the Services after a change takes effect, you accept the updated Terms. Changes do not apply to a dispute that arose before they took effect.

21. General

These Terms and our Privacy Policy are the entire agreement between you and bartr about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of assets.
